Sean G Said:
During the removal of an existing bay window as part of an installation of a newly purchased bay window in my residence on August 30, 2011, a concrete statuary fountain valued at approximately $ 3000.00 was broken beyond repair. A witness to the occurrence has stated that the window was not being supported in any way as they were removing it and that only one of the two workers on site was working on the removal. The window frame had absorbed water during a hurricane two days prior which made it heavier than usual, which both contractors were made aware of upon arrival that day as I had explained that over 6 gallons of water had leaked out of the pent roof during the storm. Jim Definis was also made aware of the problems with the window during the measuring process before the windows were ordered and that the leaking was the main reason for the replacement. At the time of measuring, no indication was made that the fountain would need to be moved.
